GetOutGarage — Terms of Service

1. Acceptance of Terms
By accessing or using GetOutGarage (“GOG,” “we,” “us,” or the “Service”), you agree to these Terms of Service (the “Terms”). If you do not agree, do not use the Service.
2. Eligibility
You must be at least 18 years old to use the Service. By registering, you represent and warrant that you meet this requirement and have the authority to agree to these Terms on your own behalf (or on behalf of an entity, if applicable).
3. Your Account
You must provide accurate, current information and keep it updated. You are responsible for all activity under your account and for safeguarding your login credentials. If you suspect unauthorized use, notify us at info@getoutgarage.com.
4. The Service
GOG is a community platform where users and companies can list vehicles, parts, events, and related content and connect via profiles, comments, messages, and links to third-party sellers. We may update or discontinue features at any time.
5. User Content & License
Definition. “User Content” means any text, images, videos, data, ratings, reviews, and other material you submit or upload.
Your rights. You retain ownership of your User Content.
License to GOG. You grant GOG a non-exclusive, worldwide, royalty-free, transferable, sublicensable license to host, store, reproduce, adapt, modify (e.g., crop, transcode), publish, publicly display and perform, distribute, and create derivative works from your User Content solely to operate, improve, promote, and provide the Service (including for backups, security, and training internal models to improve moderation/search quality—not for sale as a separate dataset).
Service providers & promotion. We may sublicense to vendors/service providers that help us run the Service, and we may use de-identified screenshots, excerpts, or thumbnails of public posts to promote GOG.
Moral rights & publicity. To the extent permitted by law, you waive and agree not to assert moral rights in your User Content and grant GOG the right to use your name, username, likeness, and any marks you include in User Content in connection with the Service.
Removal. Deleting User Content ends the license after a commercially reasonable period; residual copies may remain in backups or logs and may persist where others have re-shared your content.
Your promises. You represent and warrant you have all rights necessary to grant the above licenses and that your User Content complies with these Terms and all laws.
6. Prohibited Conduct
You agree not to:
- Post unlawful, infringing, deceptive, or harmful content;
- Harass, dox, or threaten others;
- Upload malware or attempt to access the Service without authorization;
- Scrape or use automated means without our written permission;
- Misrepresent fitment, safety, or legal compliance;
- Trade fake reviews/ratings;
- Circumvent technical measures.
7. Third-Party Links, Purchases & No Endorsement
External links. The Service links to third-party sites and products. GOG does not sell, fulfill, or ship third-party products and does not control third-party sites. If you purchase from a third party, your contract is with that seller. We are not responsible for pricing, descriptions, delivery, returns, warranties, or support.
No endorsement. Listings, links, ratings, and reviews are user-generated and informational. References to products, brands, or vendors do not constitute endorsement or recommendation by GOG.
Affiliate disclosure (if used). We may earn a commission from qualifying purchases via links; this does not affect placement or content.
On-page notice. When you click an external “Buy” or “View” link, we may show: “You’re leaving GetOutGarage. Purchases are with the seller and subject to their terms and privacy.”
8. Fitment, Safety & Assumption of Risk
Fitment not guaranteed. Parts, modifications, and settings may be incompatible with your vehicle. You are solely responsible for verifying fitment, safety, and legal compliance (including emissions and roadworthiness) and for using qualified professional installation.
Risk. Vehicle modification carries inherent risks. You assume all risks arising from modifications and reliance on information on the Service.
No professional advice. Content is informational only and not professional, engineering, mechanical, or legal advice.
9. Reviews & Ratings
User ratings/reviews must reflect genuine experiences and must disclose any material connections (e.g., sponsorships). GOG may moderate or remove content that appears deceptive or conflicts with applicable endorsement rules.
10. Moderation & Enforcement
We may remove or restrict content and/or suspend or terminate accounts that, in our reasonable judgment, violate these Terms or harm users or the Service. When feasible, we’ll notify you and provide an appeal path. We may preserve and share content with law enforcement if legally required or to protect safety.

Notices. Send DMCA notices/counter-notices with all required elements (17 U.S.C. §512). We will respond to proper notices and may terminate repeat infringers. We maintain and enforce a repeat-infringer policy and standard notice/counter-notice procedures.
12. Payments; Fees
The Service is currently free. If we introduce paid features, we will present additional terms for acceptance.
13. Disclaimers (No Warranties)
THE SERVICE, CONTENT (INCLUDING USER CONTENT), AND LINKS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, GOG DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not guarantee that the Service will be uninterrupted, secure, or error-free, that content will be accurate or complete, or that defects will be corrected.
14. Limitation of Liability; Release
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GOG AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOSS OF PROFITS, REVENUE, DATA, GOODWILL; OR COSTS OF SUBSTITUTE SERVICES, ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS.
Liability Cap. GOG’s total liability for all claims in the aggregate will not exceed the greater of $100 or the amounts you paid to GOG (if any) for access to the Service in the 12 months preceding the event giving rise to liability.
Release re third parties. You release GOG from claims arising out of or related to your dealings with third-party sites or sellers linked from the Service.
Some jurisdictions do not allow certain disclaimers or limits; in those places, we limit our liability to the minimum extent permitted.
15. Indemnification
You agree to defend, indemnify, and hold harmless GOG and its affiliates from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from your User Content, your use of the Service, or your violation of these Terms or applicable law.
16. Dispute Resolution — Informal Process, Arbitration, Opt-Out, and Mass-Arbitration Management
Informal resolution first. Before filing a claim, email legal@getoutgarage.com with a written Notice of Dispute describing the issue and relief sought. We’ll try to resolve within 30 days.
Binding arbitration; class-action waiver. Except for small-claims or injunctive relief for misuse of IP or unauthorized access, any dispute between you and GOG arising out of or relating to these Terms or the Service will be resolved by binding, individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. No class or representative actions or arbitrations. The Federal Arbitration Act (FAA) governs interpretation and enforcement of this section.
Venue & seat. If in-person hearings occur, they will take place in Los Angeles County, California, or in your county of residence if required by AAA rules.
Fees. AAA rules will govern fees; for non-frivolous claims under $10,000, we will pay consumer filing, admin, and arbitrator fees to the extent required by AAA rules.
30-day opt-out. You may opt out of arbitration within 30 days of first accepting these Terms by sending your name, the email tied to your account, and a clear opt-out statement to legal@getoutgarage.com or by mail to Your address. Your opt-out will not affect your use of the Service.
Mass-arbitration protocol. If 25 or more similar claims are asserted by the same or coordinated counsel within 90 days, the parties agree to: (i) batch the claims into groups of up to 50 and select 10 bellwether cases to proceed first; (ii) stay the remainder; (iii) after the bellwethers, participate in global mediation; and (iv) if unresolved, continue in subsequent batches. Fee obligations for batched filings will be phased consistent with this process. Either party may ask AAA to apply its mass-filing protocols; if AAA declines, the parties will confer in good faith to select a mutually acceptable administrator. This paragraph does not waive the individual nature of each claim.
Small-claims court. Either party may bring individual claims in small-claims court in a venue with jurisdiction.
17. Governing Law; Venue
These Terms are governed by the laws of the State of California, excluding its conflicts rules, and by the FAA for arbitration issues. Where a claim proceeds in court (e.g., qualifying IP/injunctive issues or small claims), the state or federal courts in Los Angeles County, California will have exclusive jurisdiction, and you consent to personal jurisdiction there.
18. Changes to Terms
We may modify these Terms. For material changes, we will provide notice (e.g., email or in-app banner) at least 30 days before they take effect. Continued use after the effective date constitutes acceptance. If you do not agree, you must stop using the Service.
19. Termination
You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or if needed to protect users, our systems, or comply with law. Provisions that by nature should survive (e.g., licenses granted, disclaimers, limitations, indemnities, dispute resolution) survive termination.
20. Miscellaneous
No waiver of any term is a continuing waiver. Severability: if any term is unenforceable, it will be modified to the minimum extent necessary or severed, and the rest remains in effect. You may not assign these Terms without our consent; we may assign to an affiliate or in connection with a merger, acquisition, or asset sale. Force majeure: we are not liable for events beyond our reasonable control. Export controls apply to your use of the Service. If you access via a mobile app, your app-store’s terms (e.g., Apple/Google) apply to the limited extent they require.
